This site, blog and related services are designed to assist you in finding and attending our Pilates and Yoga Retreats and Teacher Trainings, and we encourage you to express yourself freely. However, be responsible in what you write, and please be respectful.

Throughout the site, the terms “we”, “us” and “our” refer to Paleymotion Ltd. and offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

We do not collect any Sensitive Data about you. Sensitive data refers to data that includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data. We do not collect any information about criminal convictions and offences.

California Online Privacy Protection Act Compliance: Because we value your privacy we have taken the necessary precautions to protect your privacy as outlined in this privacy policy. INTERNATIONAL TRANSFERS

We share your personal data within our group of companies which involves transferring your data outside the European Economic Area (EEA) (like Dropbox, InfusionSoft, Stripe, Paypal, etc., for example which reside in the United States)

Countries outside of the European Economic Area (EEA) do not always offer the same levels of protection to your personal data, so European law has prohibited transfers of personal data outside of the EEA unless the transfer meets certain criteria.

Many of our third parties service providers are based outside the European Economic Area (EEA) so their processing of your personal data will involve a transfer of data outside the EEA.

Whenever we transfer your personal data out of the EEA, we do our best to ensure a similar degree of security of data by ensuring at least one of the following safeguards is in place:

  • We will only transfer your personal data to countries that the European Commission have approved as providing an adequate level of protection for personal data by; or
  • Where we use certain service providers, we may use specific contracts or codes of conduct or certification mechanisms approved by the European Commission which give personal data the same protection it has in Europe; or

DATA SECURITY

We have put in place security measures to prevent your personal data from being accidentally lost, used, altered, disclosed, or accessed without authorization. We also allow access to your personal data only to those employees and partners who have a business need to know such data. They will only process your personal data on our instructions and they must keep it confidential.

We have procedures in place to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach if we are legally required to.

We implement a variety of security measures to maintain the safety of your personal information when you place an order or enter, submit, or access your personal information. We do not accept or receive personal financial information on our website or through email.  All supplied sensitive or credit information is transmitted via Stripe's / PayPal's order forms which uses its Secure Socket Layer (SSL) technology. All of this information is encrypted into Stripe's / PayPal's  Payment gateway provider’s database and is accessible only by authorized personnel with special access rights to such systems who are required to keep such information confidential. After any transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers.

DATA RETENTION

We will only retain your personal data for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

When deciding what the correct time is to keep the data for we look at its amount, nature and sensitivity, potential risk of harm from unauthorized use or disclosure, the processing purposes, if these can be achieved by other means and legal requirements.

In some circumstances we may anonymize your personal data for research or statistical purposes in which case we may use this information indefinitely without further notice to you.

Under data protection laws you have rights in relation to your personal data that include the right to request access, correction, erasure, restriction, transfer, to object to processing, to portability of data and (where the lawful ground of processing is consent) to withdraw consent.

Cancellation Policy

Travel Insurance

We highly encourage you to purchase travel insurance in case you need to cancel your trip. We have found during our travels that it is well worth having the coverage, as it covers many unforeseen circumstances that may arise while on vacation.

Cancellation up to 90 days before retreat start:

If we are able to fill your cancelled spot by three months before the retreat start, we will return all money paid to us, except your deposit. If we are unable to fill your spot, we will only return 50% of all money paid to us after deduction of the deposit.

Cancellation after three months before retreat start:

Sorry, but no refund possible after this date.If you are not able to attend the retreat but have a friend or family member that would like to attend, we are happy to transfer 100% of the money that you have paid toward your friend or family member. Both parties must notify us in writing in order to transfer names.

If we cancel the retreat:

All money paid to us by you will be returned, excluding bank chargers. Unfortunately we cannot compensate you for any plane tickets/transportation arrangements you have already made.

Payment general:

EUR 500 non-refundable deposit is required in order to secure your spot. We accept Credit Card (PayPal) and / or direct bank transfer. Please note that we won’t pay for any bank or transfer charges, including PayPal fees.


DISCLAIMER

Life in Movement (Paleymotion Ltd) and all persons involved in retreats (herein after referred to as "AGENTS") act only in capacity as AGENTS for the participant in all matters connected with travel, sight-seeing journeys and transportation, and as AGENTS hold themselves free of responsibility for any damage occasioned by any cause. AGENTS will not be responsible for any damages or expenses or inconveniences caused by late departures or change of schedule, strikes or to their conditions, nor will be responsible for loss or damage to baggage or any of the participant's belongings.

All prices quoted are correct at time of printing, include the cost of operation of the journeys, and are subject to currency changes. AGENTS shall not be responsible for personal injury, death, accident, delay, loss, damage, irregularity or property damage as a result of force majeure or for any other losses or damages incurred by any person or journey participants caused by any delay or change of itinerary or arising out of any act, including, but not limited to, any act of negligence, any person acting for or on behalf of AGENTS for transportation, accommodation or sight-seeing provider or any other person or entity rendering any of these services or accommodations being offered in connection with this journey.

This agreement supersedes all previous oral or written communications, representations, or agreements between the parties. Participants assume the risk involved when participating in Pilates, yoga, foreign travel, and any and all activities and/or pursuits voluntarily undertaken while participating in the retreat.

Participants agree that any and all disputes between Participants and Paleymotion Ltd shall be governed by Hong Kong law. Participants agree to mediate any and all disputes prior to the institution of any litigation. In the event of any litigation between the Parties to this agreement involving their respective rights or obligations, such litigation shall take place in Hong Kong and the prevailing party shall be entitled to recovery of reasonable attorney's fees and court costs of litigation.

In regard to the stay during the retreat, AGENTS will provide safe, careful instruction and safe premises, but ask that each participant to take personal responsibility for their own self-care and (in the unlikely case) for any injuries incurred during retreat. Modifications are given to students with specific needs. If participants are unsure of their physical ability due to previous injuries, they should seek the advise of a healthcare practitioner beforehand.
